1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your use of DueHub, a study-planning application operated by JDS Educational Services, LLC, a Virginia limited liability company (“JDS,” “DueHub,” “we,” “our,” “us”), available at https://app.getduehub.com and through the DueHub iOS app.
By creating an account or using DueHub, you agree to these Terms and to our Privacy Policy at https://app.getduehub.com/privacy. If you do not agree, do not use DueHub.
2. Eligibility
Student accounts. You must be at least 13 years old to create a DueHub student account. When you create your account, you provide your date of birth so we can confirm this.
Parent accounts. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create a DueHub parent account.
Users aged 13 to 17. If you are under 18, you represent that your parent or guardian has reviewed these Terms and consents to your use of DueHub. We encourage parents and guardians to review these Terms with their child before the child creates an account.
Users under 13. DueHub does not currently support accounts for children under 13. If you are under 13, do not create an account.
3. Description of Service
DueHub is a study-planning application that helps students organize assignments, plan study sessions, and view their school schedule and calendar in one place. DueHub can, at your direction, integrate with third-party services (such as Canvas, StudentVUE, Google Calendar, and iCal feeds) to import your school data.
Beta status. DueHub is currently in closed beta. This means:
- Features may change, be added, or removed without notice.
- The service may be temporarily unavailable due to maintenance, updates, or unforeseen issues.
- Bugs may occur. We strongly recommend using the “Export my data” feature periodically as a backup.
- The service is free during beta. If we introduce paid features in the future, these Terms will be updated first and you will be asked to accept the updated Terms before you can use those features.
4. Your Account
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- The accuracy of information you provide.
- Any content you create in DueHub and any third-party accounts you choose to connect.
You may not:
- Create more than one account for yourself.
- Share your account credentials with anyone else.
- Transfer or sell your account to another person.
- Access another user's account without authorization.
If you believe your account has been compromised, contact us immediately at admin@getduehub.com.
5. Acceptable Use
You agree not to:
- Use DueHub in violation of any applicable law or regulation.
- Use DueHub to violate any third party's rights, including intellectual property rights.
- Attempt to gain unauthorized access to DueHub's systems, any user's account, or any connected third-party account.
- Interfere with or disrupt DueHub's service, including through denial-of-service attacks, excessive automated requests, or attempts to overload our systems.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of DueHub, except to the extent this restriction is prohibited by law.
- Misrepresent your age, identity, or affiliation.
- Use DueHub to facilitate academic dishonesty in a way that violates your school's policies.
- Upload or transmit malware, viruses, or other harmful code.
- Use DueHub for commercial purposes without our written permission.
We may investigate suspected violations and take appropriate action, including suspending or terminating accounts.
6. Third-Party Integrations
DueHub lets you connect third-party services (Canvas, StudentVUE, Google Calendar, iCal feeds, and potentially others). When you do:
- You authorize DueHub to access data from those services on your behalf, using credentials you provide.
- Your use of those services is subject to their own terms and privacy policies.
- We are not responsible for the availability, accuracy, or reliability of those services. If a third party changes their systems, integration features may break or be removed.
- We are not responsible for the actions of those third parties.
Details about how DueHub handles data obtained from these integrations are in our Privacy Policy.
7. Family Access
DueHub offers a Family access feature that lets a student share a read-only view of parts of their DueHub account with a linked parent account.
- Family access is initiated and controlled by the student.
- Parents receive read-only access to the specific scopes the student has authorized.
- Both students and parents agree that Family access operates as described in the Privacy Policy.
- Parents agree not to attempt to circumvent scope restrictions or to view any DueHub data outside of what the student has explicitly shared.
- Sharing a link code with someone who is not your parent or guardian, or redeeming a link code that was not offered to you, is a violation of these Terms.
8. Your Content
Ownership. You retain ownership of the content you create in DueHub (your assignments, planned days, study sessions, courses, and other user-created content) and of the data you import from third-party services.
License to DueHub. You grant DueHub a limited, non-exclusive, royalty-free license to store, process, display, and transmit your content solely for the purpose of providing the DueHub service to you and to any parents you have authorized via Family access. This license ends when you delete the content or your account, except as needed to complete deletion and to comply with legal obligations.
Research use (opt-in). If you affirmatively opt in to research use in Settings, additional terms in our Privacy Policy apply to how your data may be used for research and product improvement.
Feedback. If you submit feedback, ideas, or suggestions to DueHub (through the in-app feedback form or otherwise), you grant DueHub a perpetual, irrevocable, worldwide, royalty-free license to use that feedback to improve DueHub, without obligation to compensate you.
9. DueHub's Intellectual Property
DueHub, its logo, its user interface, its underlying software, and all associated intellectual property are owned by DueHub or its licensors. These Terms do not grant you any right to use DueHub's trademarks, logos, or branding without our written permission.
10. Beta Disclaimers and Warranty Disclaimer
DueHub is provided “as is” and “as available.” To the maximum extent permitted by applicable law:
- We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
- We do not warrant that DueHub will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- We do not warrant that data imported from third-party services will be accurate, complete, or up-to-date.
- You are responsible for backing up your data. DueHub provides an “Export my data” feature for this purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- DueHub, and its owners, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost profits, lost data, loss of goodwill, service interruption, or the cost of substitute services, arising out of or in connection with your use of DueHub.
- Our aggregate liability for any claim arising out of or in connection with these Terms or your use of DueHub will not exceed one hundred U.S. dollars ($100.00) or the total amount you have paid us in the twelve months preceding the claim, whichever is greater.
These limitations apply regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless DueHub and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your violation of any third party's rights, including intellectual property or privacy rights.
- Your content or your use of DueHub.
13. Termination
Termination by you. You may delete your DueHub account at any time through Settings → Account → Delete account. Deletion is described in detail in our Privacy Policy.
Termination by us. We may suspend or terminate your account if:
- You violate these Terms.
- Your use of DueHub creates risk or possible legal exposure for us or for other users.
- We are required to do so by law.
We may also discontinue DueHub or any of its features at any time, with notice where reasonably practicable. If DueHub is discontinued, we will provide notice and a reasonable period for you to export your data.
Effect of termination. On termination, your right to use DueHub ends. Provisions of these Terms that by their nature should survive termination (including Sections 8, 9, 10, 11, 12, 14, and 15) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles.
Any dispute arising out of or in connection with these Terms or your use of DueHub will be resolved exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction and venue of those courts.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and request your re-acceptance from within the application. Continued use of DueHub after changes take effect constitutes acceptance of the updated Terms.
16. Miscellaneous
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and DueHub regarding your use of DueHub and supersede any prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
